| 摘 要： | 对非法证据概念进行梳理,阐释非法证据排除规则的理念,非法证据排除规则反映了刑事诉讼中控制犯罪与保障人权的博弈.非法证据排除规则无论是理论上的争议,还是实务中的操作,在社会上都引起极大的关注,从尊重和保障人权理念、促进司法公正、体现法治尊严方面,探讨非法证据排除规则的价值取向.

| Abstract: | By collating illegal evidence, and illustrating the idea of exclusionary rule of illegally evidence, it can be fouund that il- legal evidence reflects the struggling between the control of crime and the protection of human rights in penal lawsuit. Theorically and practicaaly, there is great dispute in the public. The thesis probes into the value orientation of the exlusionary rule of illegally evidence from aspects of the protection of human rights and the promotion of judicial justice. |
