| 摘 要： | 惩罚性赔偿责任的法律制度已纳入了我国民法典的专家建议稿(草案).对这种新生的事物,民法学界不乏反对之声.文章试图逐一进行批驳,论证惩罚性责任存在和发展的必要性,并针对学者对这种赔偿责任功能的分析作一简要的评述.
