论民主的法治前提

民主与法治既有不同的历史渊源和政治理念 ,又有共同的价值关怀 ,这使得二者在近代的结合成为可能和必要。在实践中 ,法治具有优先于民主的地位 ,是实现民主和保证民主正常运作的必要前提。观照我国法治发展滞后的现实 ,急需从如下三方面着手加强法治建设 :加强宪法权威 ;落实公民权利 ;力求公正执法。

On the Rule of Law: A Precondition to Democracy

Democracy and the rule of law are different in history resources and political ideals but the same in value concerning, which makes their recent union possible and necessary. The rule of law is prior to democracy in practice and thus is necessary precondition to the realization and ensurance of democracy. The fact that China is backward in legal construction makes it important to enhance the rule of law. The present task should mainly focus on three aspects: to enhance the institutional authority, to ensure the civil rights and to enforce the law fairly.
