《南海行为准则》法律框架研究

作为今年东盟外长会议和中国与东盟10国的"10+1"外长会谈的关键议题之一,《南海行为准则》的协商和制定一直受到国际社会的广泛关注。为了更好的推动和落实《南海各方行为宣言》,进一步缓和南海冲突、稳定南海局势,实现南海可持续发展,有关国家应当秉持开放态度,逐步营造有利于解决南海问题的积极氛围,尽早就《南海行为准则》达成共识。

A Study of the Legal Framework of The Code of Conduct in the South China Sea

As one of the key issues of the 45th ASEAN foreign ministers meeting and the ＂ 10 ＋ 1＂ foreign ministers meeting between China and ASEAN countries, The Code of Conduct in the South China Sea has been widespread concerned by the international community. In this regard, the Chinese govemment has been uphold- ing a positive attitude during the whole consultation and insisting that the process should be carried out between China and ASEAN countries. For the purpose of promoting The Declaration of Conduct in the South China Sea, reducing tensions and finally achieving sustainable development in this area, China and ASEAN countries should always uphold an open mind and create a positive atmosphere to deal with the territorial disputes regard to the general principles, common objectives and subject contents of The Code of Conduct in the South China Sea.
