| 摘 要： | 提供虚假证明文件是特殊主体犯罪,其主体能力的差别虽然对定罪没有影响,但对量刑具有一定意义。强调提供虚假证明文件罪是情节犯的目的,在于正确划清罪与非罪的界限,而对行为人是否构成其他犯罪的共犯及是否构成数罪的探讨,将有助于司法实践中正确适用法律。

| Abstract: | It is the special subject of crime to supply fake certificates, which is meaningful for the measurement of punishment, even though it does not count in determination of the degree of crime for the difference of ability of the subject. Its aim lies in finding a limitation of crime or non-crime to emphasize circumstance criminal. It is helpful for the correct use of the legal statutes in practice to study whether the actor has involved either in some accomplices or plural crimes. |
