论有中国特色的新审级制度的构建

实现诉讼公正与效率的双赢,是我国司法制度改革的主要目的,要达到此目的,必须从审级制度改革这一关键问题入手。我国应改革现行的两审终审的审级制度,将事实审与法律审分开,并将其恒定为第一次上诉审法院和第二次上诉审法院的专属职权,废除审判监督程序,以此构建有中国特色的三审终审制度。

The Construction of a New System of Trial Grades

The realization of fairness and efficiency in litigation is a major aim of the reform of the judicial system in China, for which the reform of the trial grade system must goes first. The present system of the second instance being the final instance should be changed so that the trial of fact will be separated from the trial of law and make it the permanent exclusive competence of the first and second court of appellate jurisdiction. In this way we can establish a system of the third instance as the final with Chinese characteristics.
