转质探析

转质是质权人享有的一项重要权利,分为承诺转质和责任转质两种类型。二者虽然性质基本相同,但在成立的条件、质权人的责任以及转质权实行的要件等方面却有很大不同。我国有必要在立法上明确规定转质,但对责任转质应规定严格的条件。

To deliver the pledged property is an important right that pledge enjoy,and it's divided into two forms:one is to promise to deliver the pledged property,and the other is to deliver the pledged property on responsibility.Although the two forms are nature basically the same,but they're different in the condition established,the responsibility of the pledge and important document implemented,etc..The legislation in our country should stipulate clearly the delivering the pledged property ,but also should stipulate strictly the pledged property on responsibility.
