我国死刑将长期存在的必然性——对立即、尽快废除死刑主张的几点质疑

我国目前的国家发展水平、社会环境和法律环境,并不具备立即废除死刑的条件,尽快废除死刑的时机也不成熟。一些学者立即废除死刑、尽快废除死刑的主张,多数是在自己不断深入的法学理论研究基础上产生的结论,是建立在理论上的理论,是超前的理论。这种主张与社会实际相脱节,也与广大普通公民、尤其是生活在社会底层大多数民众的愿望、体会相悖。我国目前废除死刑,可能损害社会公平,导致社会秩序恶化。党和人大在死刑存废的决策上,应当多听听广大民众的呼声。

The Necessity of Long Existence of Death Penalty in China:Questioning about Immediate and Quick Abolishment of Death Penalty

Chinese national development level,social environment and legal environment are not supposed to be suitable for abolishing the death penalty immediately or as soon as possible.Some scholars’ views for abolishing the death penalty immediately and as soon as possible are mostly the conclusion based on their continuously deepened theoretical study.Their theory is just based on the law theory and is a futuristic theory.Their proposal isn’t suitable for social reality,especially most grass root people.It contradicts their wills and feelings.If China abolishes the death penalty now,it may do harm to social equality and lead to the deterioration of social order.When the National Peoples Congress makes the policy about abolishing,they should listen to the views of the masses..
