| 摘 要： | 随着人类文明的发展,世界环境问题也日益严重,中国的环境现状更是如此。但由于中国环境立法的不完善,及相关理论研究的不深入,都为环境侵权的解决带来了困难。介绍了目前中国学者在环境侵权民事责任概念、外延及构成要件等方面存在的分歧。阐述了环境民事侵权责任,论述了环境民事侵权责任应适用无过错原则的理由。
