| 摘 要： | 婚约并非以结婚而是以婚姻关系为目的，是未婚男女对婚姻关系的预先约定；而彩礼是男女双方按照婚约习俗以婚姻为目的由一方交付给另一方的财物。《关于适用〈中华人民共和国婚姻法）若干问题的解释（二）》对彩礼返还进行了规定，但其法理根据不足。彩礼返还以婚约解除为条件，但应考量两个因素：一是过错因素，对婚约的解除或不解除有过错的彩礼给付方丧失彩礼返还请求权；二是婚约期待期，婚约期待期以结婚后八年为宜。
