浅论司法审查制度

司法审查制度在西方社会已存在了两个世纪,本文以西方司法审查制度的渊源及理论依据为切入点,对比分析我国司法审查制度的历史及现状,认为在我国建立司法审查制度是现实之必须。同时论述在我国如何建立司法审查制度,以求证于方家。

Discussion on Judicial Review

Judicial Review has been existed two centuries in the Western World, but it is not passed in Mainland china. This paper mainly discusses the source and theory of this system .The writer tells its history in our country, too. At last, the writer thinks that it is necessary to establish Judicial Review in China, at the same time the writer gives some advice to set up this system.
