论欠缺行为能力老年人政府监护模式的困境与重构

随着全球人权保障水平的提升与成年监护理念的革新,曾经在我国发挥重要作用的现行政府监护模式因监护模式单一、未尊重老年人意愿等问题而陷入困境。 政府监护模式的设计必须要面对和解决的是平衡尊重欠缺行为老年人自主决策权与利用监护手段保护老年人权益之间的关系,防止公权力对私权利的过度干预。 因此,我国需要对现行的政府监护模式进行重构,倡导有限制的监护理念,提供必要的公共法律服务,加大政府的财政支持和专业人才的引进与培养,构建在政府监护机构与司法机关共同监督之下履行政府监护职责的社区服务模式。

The Predicament and Reconstruction of ChinesePublic Guardianship Model for the IncapacitatedElderly

With the improvement of the global level ofhuman rights protection and the innovation of theconcept of the adult guardianship, the elderly publicguardianship model which has played an important rolein China fails to keep pace with the development of thesociety because of single guardianship mode, beinglack of respecting the wishes of the elderly and so on.The design of China''s public guardianship systemshould solve the problem of the relationship betweenrespecting the autonomy of the incapacitated elderlyand protecting the rights of the elderly by guardianshipin order to prevent the public power from excessivelyinterfering with private rights. Therefore, it isnecessary for China to reconstruct the existing model ofpublic guardianship, and implement limited adult guardianship. Also, it is compulsory to provide publiclegal services and financial support and increase theintroduction and training of professionals, that is, thecommunity service model under the supervision ofpublic guardianship agencies and judicial organs.
