从利益构成要素视觉看环境法调控的利益矛盾

利益作为一种社会关系范畴,由利益主体、客体及中介三要素构成,利益的本质是一种矛盾。根据利益构成要素的不同,可把众多的利益矛盾分为:利益主体与利益客体之间的矛盾;利益客体之间的矛盾;利益主体相互之间的矛盾。从利益构成要素角度看,环境法调控的利益矛盾具体包括人口与资源间的矛盾;经济利益与环境利益间的矛盾;公益与私益、代内利益与代际利益之间的矛盾。从利益构成要素视觉分析环境法调控的利益矛盾对环境法部门建设及和谐社会下的法制建设都具有重要意义。

On Interest Contradictions Adjusted by Environmental Law from the Perspective of Interest Components

As a kind of social relation category,interest is constituded by three components of man subject,object and medium.And its essence is a kind of contradiction.According to elements of interest,varieties of interest contradictions are classified into three:contradiction between man subject and object,contradiction between objects,contradiction between man subjects.From the angle of elements of interest,interest contradictions adjusted by envirmental law actually include contradiction between population and resources,between economy development and environment protection,between public interest and private interest,inter-generation benefit and cross-generation benefit.This method of analysis is important for the construction of Environmental Law and the whole law system in harmonious society.
