信访制度的法治化改革:广东个案

信访制度是一项植根东方文化、颇具中国特色的制度设计,近年来因信访带来的诸多社会问题而备受争议。《广东省信访条例》起草过程中对信访功能定位法治化、信访程序法治化、信访组织体制法治化等方面作了有益探索,力图运用法治思维和法治方式破解信访困局,通过地方立法为信访工作和信访活动提供强有力的法治保障。广东省的做法或可为全国范围内信访立法质量提升提供镜鉴。

Legalization Reform of Petition System： Guangdong Case

Petition system is a kind of institutional design rooted in the eastern culture with Chinese characteristics, however, it has become controversial in recent years due to many social issues arising from petition activities. During drafting the Regulations on Petitions in the Form of Letters and Visits of Guangdong Province, an attempt has been made to institutionalize the functional orientation of petition, petition procedures and petition organization system. It aims to break through the petition dilemma by means of the ＂rule of law＂ thinking and approaches and to provide legal guarantee for petition work and activities through local legislation. Guangdong＇s practice may provide reference for the rest of China in terms of improving petition legislation.
