| 摘 要： | 国家主权理论在当代的发展和创新,离不开全球治理理念为其提供的理论支撑与创新,尽管后者在理论上尚不具备完整的体系建构,在实践中也处于形成和发展的阶段。尽管两者之间无论是在理论还是在实践上都显示出一定的张力,但其相互影响的表现恰好体现出两者在发展方向上的契合,这也反映出了当代国际法正由"共存国际法"日益向"合作国际法"过渡的发展大趋势。

| Abstract: | The contemporary development and innovation of the theory of state sovereignty cannot do without theoretical support and innovation provided by the concept of global governance, although the latter in theory has not formed a complete system, and is also at the stage of formation and development in practice. Although there has shown some tension in theory and practice between the both two, the performance of the interaction just shows the fit in their direction of the development, which also reflects the transition of the development trend of contemporary international law that the ＂co-existence international law＂ is now increasingly changing into the ＂cooperation in international law＂ . |
