| 摘 要： | 商业秘密构成要件的认定在知识产权保护中具有重要意义。本文参考国际公约、立法、学说及判例 ,对商业秘密的构成要件作出了具体界说。商业秘密的构成要件应包括不为公众所知悉、能为权利人带来经济利益、具有实用性并经权利人采取保密措施四个方面的内容

| Abstract: | The specification of the constituents of commercial secrets is significant in the protection of intellectual assets. This paper specifies and delimits the constituents of commercial secrets with reference to international agreements, related laws, theories and cases. The constituents of commercial secrets should include the contents which are unknown to the public, beneficial to the obligee, practical and secret keeping by the obligee. |
