“严打”是一种指导打击和预防犯罪的具体刑事政策。在贯彻“严打”政策时,要处理好刑事政策与刑事法律的关系,在发挥刑事政策有利于打击犯罪积极作用的同时,约束“严打”破坏法制的冲动;处理好“严打”政策与刑罚轻缓化政策辩证统一的关系,用“严打”的本质要求消除“严打”一极化的发展弊病;处理好贯彻“严打”政策与保障人权的关系,努力提高执法者的宪法意识、程序意识和用和谐社会理念指导司法工作的意识。
