法理学的定义视角分析

我国目前对法理学的定义多种多样,虽有其合理性,但也存在不少问题.有的定义深受近代自然科学研究范式的影响,有的定义过分强调法理学的思想性而显得太纯粹,有的定义却有打破法理学学科体系的取向.结合我国法理学研究的现状,我们认为,定义法理学只有遵循现实性、概括性和有效性三项标准,才能既利于我国法理学体系的构建,又利于同西方法理学对话.

An Analysis of Definition Visual Angle of Jurisprudence

Though the current definitions of jurisprudence in China seem to be reasonable, some questions still exist.Some are affected by the paradigms of the modern natural scientific study,some emphasize the thought of jurisprudence,some have the purpose of destroying the system of jurisprudence.We should stick to three standards of defining jurisprudence,including reality,generality and validity,so as to make it favorable for both the construction of system of Chinese jurisprudence and the communication with western countries.
