论中国房地产市场的政府规制——兼评“房屋限购令”的合法性

摘    要:房地产市场的稳定发展需要政府进行有效规制。但是,政府规制应该以房地产市场的自我调节为前提,充分考虑市场效率。政府规制应该适度、合法,要根据实际情况而有所放松或者加强。政府应该在市场准入、土地交易等环节逐步放松规制,增强市场活力。对信息不对称的规制和对规制者的规制是当前需要加强的重要方面。

Abstract:The stable development for real estate market needs the effective regulation of government.However,governmental regulation shall take the self-adjustment of real estate market as a presupposition,which ought to consider the efficiency of market.Governmental regulation should be moderate and lawfull,as the change of practice to reinforce or release.Release on market access and land transaction will be calculated by government so as to add the market energy.As for the issue of information asymmetry and regula...
