| 摘 要： | 国际商会可否在中国内地仲裁,其裁决应如何认定及执行,在中国仲裁界备受争议。通过对宁波中院有关裁定的分析,可发现其在裁判逻辑、法律适用与解释上的不足。该裁定将国际商会在中国内地所作裁决认定为非内国裁决,依据《纽约公约》承认与执行的做法,未从根本上解决此类裁决的国籍问题,并与我国加入公约时的互惠保留相违背。考虑此类实践难题的化解,以及近期我国司法实践的发展动向,我国仲裁立法亟待明确以仲裁地作为裁决国籍的认定标准。
