论投资与市场准入行业行政审批的替代措施:黑名单制度

投资与市场准入行业的行政审批取消后,黑名单制度可以作为行政审批的替代措施,成为行政机关的日常监管手段,填补行政审批取消后监管的不足和弱化。在分析我国行政领域现状的基础上,构建投资与市场准入行业的黑名单制度,以向社会公开曝光形式形成对企业的威慑力。失信成本的增加可使企业自觉遵纪守法,降低行政机关的监管成本。黑名单制度的收益会远远大于黑名单制度的成本。但黑名单的使用要慎重,要有法律依据,同时也要求行政机关加强自我规制,转变执法观念。
