试论城市房屋拆迁中政府职能的错位及其对策

近年来，在城市房屋拆迁中政府侵犯被拆迁人权益的现象屡见不鲜，其主要原因是政府未能找准其在城市房屋拆迁中应扮演的角色，因此，政府在城市房屋拆迁中的职能必须回归和到位。一要逐步取消城市房屋拆迁行政许可制度；二要取消政府的行政裁决权和强制拆迁权；三要政府认真做好城市房屋拆迁的指导、监督、管理、协调工作。
