| 摘 要： | 行政规制应当遵守效益原则.效益原则的具体内容包括市场竞争机制能够有效自行调节的领域,行政机关不应当介入;行政规制的成本应当小于市场失灵的成本;行政规制可以弥补市场失灵的缺陷时,行政机关应当在多种可供选择的规制措施中选择符合效益最大化原则的一种.

| Abstract: | Administrative regulation should observe the principle of efficiency.The content of the principle of efficiency includes:the administrative agency should not interfere in the field that the market system is effective;the cost of the administrative regulation should be less than the cost of market failure;when administrative regulation could make up the fault of the market system,the administrative agency should select one of the regulative measures that could maximize efficiency. |
