| 摘 要： | 船舶碰撞侵权责任制度对受害人的保护不足,需重新规制。推定过失与海上交通安全义务相适应,适合于对受害的第三人的救济;互有过失碰撞致第三人的财产和人身损害,均应采用连带责任;对于船舶碰撞致船员工伤,应明确船员和有关权利人享有工伤保险赔付和人身损害赔偿的双重救济权。
