论保护农田的土地开发权交易政策

摘    要:农田是具有外部收益的物品,政府有必要对农田用途转变进行干预.由于保护农田的传统政策的效果不理想,政策创新是必要的.美国的开发权交易政策既能够缓解或避免对保护区土地的开发,又能够保证业主获得公平补偿.开发权交易工具包括开发权购买和开发权转让.中国农田低效率转用的根源在于征地的非公平补偿和对集体土地开发权的不当管制.中国应该借鉴美国的经验,承认农田开发权的可转让性,并对开发权的数量施加明确限制.征地补偿标准要依据农田的开发权价值和农业用途价值确定.中国农田开发权交易还可能被用来解决"小产权房"的善后问题.
