我国城乡结合部土地利用立法完善

我国城镇化的发展使得城乡结合部土地利用出现出新的趋势,主要表现为:土地撂荒增多,建设用地使用权设立和流转方式过少,宅基地的用益功能增多。立法中应增加城乡结合部承包地使用权,建设用地使用权和宅基地使用权的设立和流转方式;增加其用益功能;强化土地行政执法和土地行政执法问责追责制度;强城乡结合部社会保障立法等配套立法。

On Perfecting Legislation of Land Usage in Rural-urban Fringe Zone

With the development of Chinese urbanization has appeared the new trend of land usage in the ru- ral-urban fringe zone： the increase of uncultivated land, fewer modes of establishing and circulating the use rights of construction land, and the increasing functions of the homestead. Thus, legislation should be im- proved by adding the modes of establishment and circulation of the use right of the contracted land, con- struction land, and the homestead, whose functions in use should be increased. The administrative system of accountability and responsibility in the land administrative law enforcement and the related legislation, such as the legislation of social security, ought to be strengthened.
