| 摘 要： | 犯罪故意不仅有类型之分，而且有结构形态之分。犯罪故意有三大结构形态，即心理事实形态、法律规范形态和司法推定形态。三大形态既存在合法性冲突，也存在非法性冲突，这些冲突在一定程度上影响刑事审判结果，进而影响法律正义的实现。在对三种形态进行整合时，我们应当承认冲突的不可避免性和可控制性，理性地看到由于价值需求的迁就而造成的冲突有限合理性，正确地运用这些合理性来平衡刑罚的社会保护价值和人权保障价值的冲突，最大化地实现审判结果的正义性。

| Abstract: | Guilty intent can be classified as types and structural forms as well.The three structural forms of psychological fact,legal norm and judicial presumption conflict legally or illegally,influencing the trial result in some extent and further influencing legal justice.Admitting the inevitability and controllability of the conflicts,we should rationally treat them and try to keep balance between social value and human right when conforming these three forms,and fully realize the justice of trial result. |
