电信诈骗犯罪侦查难点及实证对策研究——以重庆市各区县发案为例

电信诈骗是指随着经济的发展，报刊杂志、固定电话、移动电话、互联网等各种传媒逐渐进入人民群众的日常生活，犯罪分子便以各种传媒为载体，充分利用电信业、银行业的服务项目和监管漏洞，远距离、跨区域实施的非接触式诈骗。自2010年以来，重庆市内的电信诈骗案发案数量猛增，作案手段不断翻新，层出不穷，给人民群众带来巨大经济损失，社会危害严重。当前发生在重庆市内的电信诈骗犯罪呈现出犯罪主体集团化、职业化和诈骗流程标准化、模板化等特点，给公安机关侦破电信诈骗犯罪案件带来取证难、抓捕难、定性难、追赃难、打击难等侦破难点。破解电信诈骗犯罪的侦查难题，必须从建立打击电信诈骗犯罪的专业侦查队伍入手，进一步加强公安机关与银行业和电信业的深度合作，同时开展电信诈骗预警宣传，增强人民群众的自身防范意识。

Difficulties and Countermeasures of Telecom Fraud: Take the Telecom Fraud Cases Emerging in Chongqing for Example

Since 2010, the telecom fraud cases emerging endlessly in Chongqing have soaring number of incidence and ongoing renovation in criminal means, which causes huge economic losses and severe social harmfulness. The telecom fraud crime in Chongqing at present, characterized by collectivization in subject of crime, professionalization, standardization in fraud process and templating, leads to such detection difficulties as evidence obtaining, arrestment, determination, recovery of stolen goods and strike. To overcome the detection difficulties, the professional investigation team for striking the telecom fraud crime should be established at first so as to further strengthen the deep cooperation among the public security organs, the banking industry and the telecommunications industry. Meanwhile, early warning publicity to the telecom fraud should be carried out to enhance the awareness of the masses.
