| 摘 要： | 《海峡两岸经济合作框架协定》( ECFA)是区域贸易协定(regional trade agreement,RTA)实践和两岸经济合作机制的重要发展.ECFA在名称、主体、调整对象、基本原则、执行机制等方面显示出鲜明的“两岸特色”,不仅不同于一般的主权国家之间的RTA实践,也不同于中国RTA实践特殊形式中的内地与香港、澳门之间的CEPAs.ECFA对于实现两岸经济合作关系的正常化、法制化具有重要的里程碑意义,其对中华台北RTA实践发展可能具有的法律意义也值得关注和研讨.
