| 摘 要： | 农村集体土地是维持农民生存的基本保障,而以家庭联产承包制为主的土地制度因分散经营而无法形成规模效益,对于共同富裕奔小康目标的实现,其功能是非常有限的.对农村集体的土地依照市场法则统一进行有效经营、形成规模效益是在农村实现小康目标的主要措施,这也是我国已经实现小康目标农村的普遍作法.但目前对农村集体土地依照市场规律进行统一经营尚存在法律制度上的障碍,主要是农村集体土地所有权主体不明以及缺乏核心权能(处分权),使集体土地所有权并非真正法律意义上的所有权.中央已经明确城乡统筹为解决"三农"问题的基本原则,与此相适应,我国农村土地法律制度应该与城市土地法律制度统一起来,这是完善农村集体土地所有权制度的基本途径.

| Abstract: | Land in village is the basic guarantee to maintain farmers' lives.With the family's ownership of land on a contracted basis, the individual operation of land cannot produce a large amount of profits.So it is difficult for the farmers to realize the goal of becoming rich.The paper points out that the land system in the present-day China's countryside should be unified with the land system in cities.According to the auther of the paper, is the path to the perfection of the collective land ownership system in China's countryside. |
