| 摘 要： | 原因自由行为下正当化前提事实错误属于认识错误的一种,它应该定性为事实错误;对它的处理一般是排除故意的成立,如果刑法有规定过失犯罪的,以过失犯罪论处;在原因行为前便发生认识错误的,如何处理需要结合案情具体讨论。
