论契约的人性基础及和谐价值

性恶论认为，人不是完美的，即人性是存在缺陷的，有不足之处。广义而言，契约属于社会历史文化范畴，体现的是一种人文精神，是对特权现象以及权力或者权利滥用的一种规制。人性恶虽然是对人性的一种形而上思考，但是从一定程度上说，法治理念和契约制度的发展与人性恶的价值判断存在着逻辑上的关系。契约蕴含着自由、平等、合作、协调、诚信等和谐理念，契约及其内含的契约精神，不仅是现代市场经济的本质要求，也是现代法治国家不可或缺的灵魂。

On Basis of Human Nature of Contract and Its Value of Harmony

According to the theory of the sin of human nature, human is not perfect. That is, human being has drawbacks. In broad sense, contract falls into category of social culture and history, which is represented by human spirit, control over privilege and abuse of rights and power. Though the sin of human nature is metaphysical, there are logical relations between view of rule of law and development of contract system and judgment of value of the sin of human nature to certain extent. Contract embodies harmonious idea of freedom, equality, cooperation, coordination, goodwill and so on. Contract and its spirit are not only essential demand for modern market economy, but also indispensable soul of modern country which is ruled by law.
