| 摘 要： | 关于物权请求权究竟如何在物权法中予以规定的问题,在世界各国的立法中有代表性的几部民法典都有不同的规定。我国目前已经拟制的四个物权法草案,在这一问题上也存在着一定的分歧。我国物权法可采用的物权请求权模式有分散式、保守式、开放式、总括式四种。四种模式进行比较后,更能实现法律价值的模式是比较合理的。
