中国法治的历史背景与观念转换

本文通过对当代中国法治进程的启动背景分析和中华法系在约100年前历史性转折的追述,阐明中国的法治诉求实为世界性的现代化进程的一个必然要求和体现.法治作为现代化的重要组成部分,与中国文化传统的诸多观念存在抵触和冲突.法治的最大障碍是积淀于每个人内心深处的传统价值观念,政教法度不过是价值观念的外化.就现实而言,应重新梳理个人与集体的价值位阶顺序,认真对待"性恶论"作为理论预设的制度意义,自觉地实现观念转换,为法治的落实提供心理价值基础.

The Historical Background of Chinese Rule of Law and the Transformation in Ideology

This article expounds that claims of China's rule of law are essentially inevitable demand and embodiment of the world wide modernization advancement by analyzing the starting background of contemporary China's rule of law advancement and tracing back to about 100 years ago when the historical turn of Chinese legal system happened.Rule of law,as an important component of modernization,contradicts and conflicts with many ideas of Chinese cultural tradition.The biggest obstacle to the rule of law is the traditional values which are rooted in each person's heart.The political system and institution of law is only the external expression of values.As for reality,we should rearrange the sequence of individual and collective value,take the system significance of Nature Wicked Theory as theoretical presupposition seriously,realize the ideological transformation on our own initiative and provide the psychological value basis for the implementing of the rule of law.
