| 摘 要： | 在国家进入紧急状态下，如何在为公共利益而进行人权克减的同时，最大限度地保障人权成为国际社会的一个重要命题。从国际人权法的视角出发，在对新时期紧急状态和人权内涵进行分析的基础上，结合三大国际公约对人权的保护与人权克减之间的关系进行论证，提出紧急状态下保护人权要分别从严格履行国际义务和进一步完善监督程序两个维度来完成。
