| 摘 要： | 权利（包括权利客体）不仅仅依靠宪法和法律的规定获得合法性，而且应有哲学理论基础作为支撑。像土地、机器设备、装备这样的有形财产客体在洛克财产劳动论和黑格尔财产人格论中，有较为完整系统、令人信服的理论论证。这里运用黑格尔的人格财产论初步论证无形财产的客体——思想（专利、商标、版权的客体）存在的正当性。

| Abstract: | Legality of rights （including the objects of rights） is provided by the constitution and laws, and based on the philosophical theories. Tangible properties such as land, machinery equipment, and facilities have been systematically and convincingly explained in Locke＇s property labor theory and Hegel＇s property personality the- ory. The later theory is applied in this article to preliminarily illustrate the objects of the intangible property, ie, the legitimacy of thoughts （the objects of patents, trademarks, and copyrights）. |
