| 摘 要： | 法律文书理由是法律文书制作的灵魂,是法律文书结论的形成过程,是法治精神的最终体现。它能表现法律文书制作者的思想与认识,塑造司法公正的形象。笔者通过起诉类文书理由、申辩类文书理由、裁判类文书理由的研究,从写什么、怎么写、具体模式三方面进行探讨,以范式研究为视点论述法律文书理由的制作。

| Abstract: | As the soul of producing legal document,reason,is also the process of forming the legal document conclusion as well as the final display of the spirit of ruling by law.In addition,it presents the thoughts and understanding of the writer of the legal documents.This article studied the reasons in different types of legal documents,and probed into the content,the way and the specific pattern of the writing based on the pattern research. |
