地方政府劳动者派遣政策比较研究

比较研究北京、上海、福建等省市政府制定的劳动者派遣政策,无论是政策目标表述还是政策方案设计,都存在一定的差异。由于政策方案分别依据"一重劳动关系"说和"双重劳动关系"说来设计,对劳动者权益的维护和对派遣机构与要派企业的规制也有宽严不同程度的区别。政策的价值取向从解决下岗失业人员再就业,到注重派遣劳动者权益的维护和劳动力市场的规范,反映了政府发展观的转变。地方政府的立法实践,为中央政府制定统一的劳动者派遣政策提供了参考。

A Comparative Study on the Laborer Dispatching Policies of Local Governments

Based on the comparison between the laborer dispatching policies of provincial and municipal governments,there are some differences both in the motive expression and project plan.According to "single employment relationship" and"dual labor relationship",these policies are respectively established,which make the safeguard of laborers' rights and interests and the governmental regulations of the dispatching organizations and recruiting enterprises be different from each other.The value-orientation of the policies transfers from dealing with the issue of laid-off workers' reemployment to the issues of protecting the rights and interests of dispatched laborers and regulating the labor market,which reflects the change of governmental idea on development.Therefore,the legislation and policies made by the local governments are of great importance for the central government to establish the laborer dispatching legislation in the future.
