| 摘 要： | 自然人是近现代民法上的最为基础的概念,自然人的规定不仅仅是相对于法人而言,而有其独立的价值和意义。究其实质,自然人的思想反映了启蒙思想对法律,尤其是民法的最为根本性的影响。自然人思想构成了近现代法律的基础,也是国家与个人重新统一的基础。
