社区矫正纳入司法体系的法律构建与完善

社区矫正是当代中国刑罚制度改革的一项重要内容,但目前的社区矫正试点工作存在法律依据不足、机构设置和人员配备不尽科学合理、任务不完善等问题。对此,本文提出了完善立法、建立专业化的社区矫正机构和社区矫正工作者队伍等建议,以期促进社区矫正制度建设。

The Forming and Improving of Law on Community Rectification into Judiciary System

Community rectification is an important item in the reform of China's punishment system,but now there exist some problems in the experimental unit such as lacking of lawful basis,unreasonable establishment of some organizations and staff members and others.In this paper some proposals are put forward such as improving legislation,setting up professional community rectification organizations as well as staff members so as to promote the construction of community rectification system.
