| 摘 要： | 从剖析患者知情同意权制度的现实困境可以发现,欠缺考量患者知情同意权依存性的研究,无法应对当下中国复杂的医疗实践。只有在健全患者知情同意权保障机制、疏导正当分歧、消弭非正当分歧的基础上,建立强患者知情同意权主义的制衡机制,防止患者知情同意权的滥用,并促使患者知情同意权与医生治疗决策权均获得长足的发展,才是最大限度实现患者知情同意权,推进医患关系和谐发展及医疗事业的稳步前行的或为可行的出路。
