保险诈骗罪若干问题研究

作为金融诈骗犯罪之一的保险诈骗罪是一种新型的犯罪。市场经济条件下 ,保险诈骗罪严重损害金融体制改革 ,破坏保险事业的健康发展 ,文章对保险诈骗罪客观行为中的两个问题展开探讨 ,并重点分析了犯罪的主观目的 ,同时分析此种犯罪的共同犯罪形式 ,最后 ,对保险诈骗罪与民事欺诈和保险合同纠纷问题进行必要的区分。

The Probe of Several Problems about Insurance Swindling Crime

Insurance swindling crime, one of financial swindling crimes is a new type of crime. Under socialist market economy, it seriously damages the transformation of financial system, and destroys the development of insurance cause. Firstly, this paper will discuss two problems of the crime's objective aspect, then it analyzes the subjective intention of the crime and its joint offence form, and finally it analyzes the differences among insurance swindling crime,civil insurance fraud and the debating problems of insurance contract.
