| 摘 要： | 将我国司法改革进程与国外司法改革进程进行了比较,阐述了三个容易让人忽视和误解的问题一是我国司法改革的合宪性问题;二是我国司法改革的公众参与问题;三是我国司法改革中对于法院职权究竟是弱化还是强化的问题.

| Abstract: | In this paper,I mainly try to compare the reform of Administration of Justice itself of China with the re- form abroad and also I will state three problems which people usually and easily ignore and misunderstand:The first problem is that our reform should match with the Constitution.The second one is that whether the public should take part in the reform.The last one is whether the official powers of the Court will be weakened or rein- forced in the reformation. |
