论自然人民事行为能力制度之重构

民事行为能力制度是民法基础理论问题。我国现行自然人民事行为能力制度存在等级划分不合理;划分标准缺乏准确性;对行为能力欠缺者过于保护;相关配套制度不合理、不完善等诸多问题。针对于此,现行自然人民事行为能力制度应重新构建,应依照新的划分标准将其划分为完全民事行为能力与限制民事行为能力两个等级,建立并完善宣告、亲权和监护等相关制度。

Discussion of the Reconstruction of System of Natural Person's Civil Ability

The system of natural person＇s civil ability is a basic theory problem, and there exists many problems in our country now such as irrationality of distinguished grade,lacking veracity distinguished standard, over-protected for the lacking ability person, irrationality and faultiness of related systems,etc. To solve the above problems the system of natural person＇s civil ability should be reconstructed,and the total civil ability and the limited civil ability should be divided according to a new distinguished standard, should be established and perfected and the related system on proclaim, parental right and custody.
