| 摘 要： | 人权视野下的罪犯权利保护呼唤刑事执行权的规范运行。以刑事执行权的性质定位为出发点,在权力、权利的矛盾综合体中,为达到刑事执行权与罪犯诉权的平衡,应引入法律监督权以实现权力与权力、权力与权利的相对对等状态,并应在制度建设方面对个体诉权的保障以及法律监督权的完善进行制度构想。
