| 摘 要： | 刑事司法制度处于多种利益和价值观念的矛盾之中,有效证明与维护程序正当是这些矛盾的集中表现.有效证明是现代国家刑事司法制度的理想目标,而排除非法证据则是维护程序正当的内在要求,二者的矛盾集中表现在非法证据的采信或是排除上,协调和解决二者矛盾的途径是构建合理的非法证据排除制度.

| Abstract: | Criminal judicial system lies in the contradiction between various interests and concept of value; the effective proof and the protection program legality are the central display of such contradictions. The effective proof is the ideal purpose of the modern country's criminal judicial system and the removal of unlawful evidences is the proper internal demand of protection program legality. The contradiction between the two centrally expresses itself in the adoption or removal of the unlawful evidence. The way to coordination and solution of the contradiction between the two is the construction of the rational system for removal of unlawful evidence. |
