论刑事附带民事诉讼制度的完善

在现有的立法现状及司法实践中,刑事附带民事诉讼存在的主要问题是,附带民事诉讼制度的理念应进一步的转变;赔偿的主体及范围还没有理顺;刑事附带民事诉讼制度还不能很好的保护被害人的合法权利等.本文认为,应从构建和谐社会的角度处理好社会、国家、被告人以及被害人之间的利益辩证关系,进一步完善刑事附带民事诉讼制度.

On the Consummation of the Criminal Supplementary Civil Lawsuit System

In the existing legislation situation and the judicial practice,the main question existing in the criminal supplementary civil action is that the idea of supplementary civil action system should further be transformed;that the compensation main body and the scope have not been straightened out;that the criminal supplementary civil action system cannot protect the victim's lawful right and so on.This article believes that we should correctly deal with the relations between society,nation,the accused person and victim's benefit from the perspective of constructing harmonious society,and further consummate the criminal supplementary civil action system.
