| 摘 要： | 跨载体复制系复制的特殊形态,原《著作权法》排除了对跨载体复制的司法保护,这有其特定时期的特殊原由。然而时至今日,我国的著作权保护水平已有了长足的进步,《著作权法》(修正)却依然未对著作权人的跨载体复制权予以明文规定,这不仅不符合国际著作权司法保护的发展趋势,同时带来一系列实践中的问题。为促进我国著作权保护水平的提高,切实保护著作权人的复制权,应当分阶段从立法上予以补充和完善,将跨载体复制权纳入司法保护体系。

| Abstract: | Transforming carrier duplication is a special form of duplication.It was reasonable for the former Copyright Law to exclude protection of right of transforming carrier duplication in special periods.However,with the level of copyright protection in our country having advanced so far,the Copyright Law(amended) has not yet included a explicit definition of right of transforming carrier.It's not only inconsistent with the developing trend of international protection of copyright,but also brings a few problems in practice.To accelerate copyright protection in China and protect owners' right,it's necessary to perfect legislation step by step and bring right of transforming carrier duplication into our judicature system. |
