| 摘 要： | 调解是替代性争议解决方式的重要方式,调解在美国获得了成功并且适用范围不断扩大。其中最为重要的原因就是对调解的保密性问题做出了较好的规定,这些均对于我国调解制度的现代化具有重要的意义。

| Abstract: | Mediation is one of the most important alternative dispute resolutions; it acquired great success in resolving disputes in the U.S.A, which made it applicable on much broader scope of disputes. This article makes a deep study on the legal problems of mediation in U.S.A, especially on the confidentiality of mediation information in the followed civil or criminal processes, then, it conclude that the mediation practice in U.S.A. will contribute to the modernization of traditional mediation in China. |
