| 摘 要： | 作为一项新兴的环境行政规制手段,排污权交易制度需要接受现代行政法上法律保留原则的约束,其顺利推行应具备信息公开、听取意见和说明理由等程序要件。排污权交易实施后政府的重新规制应重视行政登记、行政合同等事后监督型和非权力性规制方式的运用。

| Abstract: | As a new type of environmental regulation measures,emission trading system should follow the principle of law reserves,and its implementation should be provided with information publicity,hearing and reason-giving.Government regulation of emission trading should observe and perform the post-trading supervision and non-authority regulation,such as administrative registration and contract. |
